The GCG issued Memorandum Circular No. 2016-02 dated 22 April 2016 entitled Revised Whistleblowing Policy for the GOCC Sector. It mandated all GOCCs to establish their own whistleblowing systems, duly approved by their respective Governing Boards, and provide a working environment that promotes whistleblowing and establish such regulations that protects whistleblowers against retaliation.

The purpose of the Whistleblowing Policy is to enable any concerned individual to report and provide information, anonymously if he/she wishes, and even testify on matters involving actions or omissions of the Directors, Officers and employees of SHFC, that are illegal, unethical, violate good governance principles, are against public policy and morals, promote unsound and unhealthy business practices, are grossly disadvantageous to SHFC and the Government.

Reportable Conditions

Whistleblowers may also report such other acts or omissions that otherwise involve violations of the following laws, rules and regulations:

A) Revised Penal Code Title II and VII : Crimes Against the Fundamental Laws of the State
B) Republic Act No. 7080 : An Act Defining and Penalizing the Crime of Plunder
C) Republic Act No. 6713 : Code of Conduct and Ethical Standards for Public Officials and Employees
D) Republic Act No. 3019 : Anti-Graft and Corrupt Practices Act
E) Republic Act No. 10149 : GOCC Governance Act of 2011
F) GCG MC No. 2012-07 – Code of Corp Governance : Code of Corp Governance
G) GCG MC No. 2012-06 – Ownership and Operations Manual : Ownership and Operations Manual
H) GCG MC No. 2012-05 – Fit and Proper Rule : Fit and Proper Rule
I ) Executive Order No. 292 : Instituting the Administrative Code of 1987
J) IRR RA 9184 : Procurement Reform
K) Violations of EO 272, Series of 2004 and/or SHFC s Articles of Incorporation and By-laws
L) Other GCG Circulars and orders, and applicable laws and regulations

GCG Whistleblowing Web Portal

The Governance Commission has established the website www.whistleblowing.gcg.gov.ph as its primary reporting channel for whistleblowers under this memorandum circular.

This reporting channel is an online-based platform by which whistleblowers may securely submit reports electronically while at the same time ensuring their anonymity and the confidentiality of their reports.

Whistleblowers from SHFC are encouraged to utilize this online reporting channel in case it opts to report the alleged illegal or unethical act or omission directly to GCG.
